EMERGENCY SERVICES ORDINANACE

ORDINANCE NO. _______
AN ORDINANCE OF NEW HANOVER TOWNSHIP BOARD OF SUPERVISORS AMENDING THE CODE OF ORDINANCES OF THE TOWNSHIP OF NEW HANOVER TO AMEND CHAPTER 7, FIRE PREVENTION AND FIRE PROTECTION, TO INCLUDE A NEW PART 1 TO ESTABLISH THE EMERGENCY SERVICES BOARD.
 
WHEREAS, the New Hanover Township Board of Supervisors are responsible for insuring the public safety of the residents of the Township in the area of fire protection services, and strive to ensure the best, most efficient fire protection services to the residents of the Township, and to provide financial accountability for all tax payer dollars; and
 
WHEREAS, the Board of Supervisors believes that an ordinance should be adopted to protect for the health and safety of persons and property during an emergency or disaster resulting from manmade or natural causes.
 
NOW, THEREFORE, BE IT ENACTED AND ORDAINED by the New Hanover Township Board of Supervisors, Montgomery County, Pennsylvania, that Chapter 7 Fire Prevention and Protection Services of the Code of Ordinances of the Township of New Hanover is hereby amended to include a new Part 1 to establish the Emergency Services Board to read as follows:
PART 1. EMERGENCY SERVICES BOARD
§7-1. Establishment. There is hereby established the New Hanover Township Emergency Services Board, whose membership shall consist of representation from volunteer emergency service agencies, Municipal Public Safety Departments and the Board of Supervisors.
 
§7-2. Purpose; AuthorityThe purpose of the Emergency Services Board is to develop procedures and techniques to coordinate the delivery of emergency services in the township and to serve in an advisory capacity to the Board of Supervisors for the purpose of recommending policy-making decisions to improve, wherever possible, emergency services for the protection to persons and property in New Hanover Township. The Emergency Services Board shall have the authority to adopt rules, regulations, by-laws and plans of action governing emergency services.  However, such rules, regulations and plans of action shall not become effective until submitted to and approved by the Board of Supervisors.
 
§7-3. MeetingsThe Emergency Services Boardshall hold meetings on a regular basis at the New Hanover Township Building at a time to be determined by the Emergency Services Board or its Chairman and to render to the Board of Supervisors current reports and/or policy-making recommendations through its Secretary.
 
§7-4. Membership. Membership in the New Hanover Township Emergency Services Boardshall consist of representation from each of the following volunteer emergency service agencies or officials within the Township Government or any other agency or official township office as may from time to time be authorized by resolution of the Board of Supervisors:
A.      Board of Supervisors: One member appointed by the New Hanover Township Board of Supervisors who shall serve as Chairman of the Emergency Services Board;
B.      Fire Services;
a.       New Hanover Township Fire Company
b.       Sassamansville Fire Company
C.      Police Services: One member of the Police Department as appointed by the Chief of Police; no member shall have affiliation with either fire department; and
D.      Private Citizens: One citizen from each of the three New Hanover Township Voting Districts.
 
§7-5. Terms. All members of the Emergency Services Board shall serve for a two year term of office that they represent; or, in the case of elected or appointed township officials, until such time as their successors shall qualify. Terms will have staggering expiration.
§7-6. Budget. Each Fire Department will have to submit and present their fiscal budget to the board for review. The fiscal year will run from January 1 to December 31.
 
                    SECTION 1. If any section, clause, provision or portion of this Ordinance shall be held invalid or unconstitutional by a Court of competent jurisdiction, such decision shall not affect any other section, clause, provision or portion of this Ordinance so long as it remains legally enforceable minus the invalid portion. The Township reserves the right to amend this Ordinance or any portion threreof from time to time as it shall deem advisable in the best interest of the promotion of the purposes and intent of this Ordinance, and the effective administration threreof.
 
                    SECTION 2. That all Ordinances inconsistent with the above provisions are repealed to the extent of their inconsistency.
 
                    SECTION 3. This Ordinance shall become effective immediately upon approval.
 
                    ENACTED and ORDAINED this _______ day of __________________, 2013.
