Public Hearing Notice
Notice is hereby given of a public hearing before the Upper Hanover Township Board of Supervisors on December 11, 2012 at 7:00 p.m. to be held at the Upper Hanover Township Municipal Building, 1704 Pillsbury Road, East Greenville, PA 18041 to consider adoption of Ordinance No. 2012-05, An Ordinance Amending The Code of the Township of Upper Hanover, Montgomery County, PA, Chapter 438, Taxation, Approving Penalty, Interest and Fee Schedule for Collection of Delinquent Real Estate Taxes. A summary of the Ordinance is as follows:
Paragraph 1: The Montgomery County Tax Claim Bureau is appointed as alternative collector and is authorized and directed to file liens for existing delinquent real estate taxes with the Prothonotary of Montgomery County
Paragraph 2: Interest shall be charged on taxes so returned from and after but not before the first day of the month following the return. Interest shall be charged at the rate of nine per centum per annum.
Paragraph 3: Reasonable charges, expenses and fees incurred in the collection of any delinquent account are fixed at five percent of the total amount of the delinquent taxes and that additional reasonable attorney’s fees incurred in the collection of any delinquent taxes shall be fixed at one percent of the total amount of the delinquent taxes and that said charges for attorney’s fees and for all charges, expenses and fees set forth herein shall be paid to the County of Montgomery through the Montgomery County Tax Claim Bureau.
Paragraph 4: The proper officials of Upper Hanover Township are authorized and empowered to take such additional action as they may deem necessary or appropriate to implement this Ordinance.
Section 1: If any section, clause, provision or portion of this Ordinance shall be held invalid or unconstitutional, such decision shall not affect any other section, clause, provision or portion of this Ordinance. Upper Hanover Township reserves the right to amend this Ordinance from time to time.
Section 2: All Ordinances inconsistent with the above provisions are repealed to the extent of their inconsistency.
Section 3: This Ordinance shall become effective immediately upon approval.
Section 4: This Ordinance is enacted by the Board of Supervisors under the authority of the Second Class Township Code and any other applicable law arising under the laws of the Commonwealth of Pennsylvania.
The public is invited to attend the public hearing and express opinions concerning the proposed ordinance. A complete copy of the ordinance may be examined in the office of the Upper Hanover Township Municipal Building, 1704 Pillsbury Road, East Greenville, PA 18041 between the hours of 8:00 a.m. and 4:00 p.m. Monday through Friday.
