NOTICE IS HEREBY GIVEN that Pennsburg Borough Council intends to adopt and enact at its regular meeting of Tuesday, May 6, 2014, at 7:00 p.m. at the Pennsburg Municipal Building, 76 W. Sixth Street, Pennsburg, Montgomery County, Pennsylvania, an ordinance requiring permits for the placement and use of bagsters, dumpsters, and temporary portable storage units on property within the Borough, regulating the placement of same within the Borough of Pennsburg and providing for penalties for violation. A complete copy of the proposed ordinance is on file with the Town and Country and is available for inspection during normal business hours at Pennsburg Municipal Building, 76 W. Sixth Street, Pennsburg, Pennsylvania, and has been provided to the Montgomery County Law Library. A synopsis of the proposed ordinance is as follows:
SECTION 1. This section establishes Definitions for the following terms: "Bagster", "Dumpster", "Temporary Portable Storage Unit", and "Unit".
SECTION 2. This section outlines certain limited exceptions to the applicability of the ordinance.
SECTION 3. This section requires a permit, application and fee in appropriate circumstances in order to locate such a unit.
SECTION 4. This section establishes the duration of time a unit may be placed on property and permits an extension of time thereof.
SECTION 5. This section regulates and establishes where on private property such units may be placed and provides certain limitations for public health and safety reasons.
SECTION 6. This section requires identification of applicant's name on the unit.
SECTION 7. This section limits the number and size of units on property.
SECTION 8. This section regulates the condition of the unit.
SECTION 9. This section regulates what materials may be stored in the unit and what are prohibited.
SECTION 10. This section imposes liability on the Applicant for any damages.
SECTION 11. This section allows for revocation of permit under certain conditions.
SECTION 12. This section provides penalties for violation of this ordinance.
SECTION 13. Rights and Remedies Cumulative.
SECTION 14. Severability.
SECTION 15. Effective Date.
